Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement

I affirm that, by participating in any Meeting, outing or workshop (the Activities) conducted by the Hamilton Camera Club (HCC), I am fully accepting as my personal risk any and all consequences of such participation, and I hereby agree to release, save harmless and indemnify the Hamilton Camera Club, its officers, directors, agents and members, from and against all claims, actions, costs and expenses in respect to death, injury, loss or damages to me or my property arising as a result of my participation.

I fully understand that (a) the Activities may involve risks and dangers of serious bodily injury, including permanent disability, paralysis and death, and also involves risk of damage, theft or loss to equipment (“Risks”); (b) these risks and dangers may be caused by my own action or inaction or the actions or inaction of others participating in the Activities, or the condition in which the Activities take place.

I agree that the HCC and its directors, officers, agents or assigns are not liable for acts by humans or of God that may occur during the Events or Activities, including, but not limited to: severe weather, earthquakes, war, terrorism, riot or other civil unrest.

I agree to engage in the HCC and any of its programs or events, including the Activities, in a reasonable fashion and not to act negligently or engage in misconduct while participating in the Activities. I understand that I will be responsible for damages that may be incurred by HCC and any other participants in the Activities that may arise out my negligence or misconduct.

In the event of an accident or medical problem suffered by me while participating at any event or Activities put on by the HCC, or co-presented in conjunction with another club or organization, I consent to the Hamilton Camera Club seeking out the appropriate medical care required and to contact the person provided as a contact by me.

I declare that I have read and fully understand this Waiver and Assumption of Risk, and that it is binding on me, my heirs, executors, administrators, and assigns.

I understand and agree that images I submit for HCC clinics, galleries, contests or other Activities may be used for education, promotion of the Club, and put up on the HCC website or entered in affiliated competitions and I accept that the HCC and its directors, officers, agents or assigns are not liable for loss, damage to, or theft of these images.

I agree that obtaining a membership in the HCC represents my deliberate consent to this agreement the lack of a written signature notwithstanding.

Intellectual Property Rights

The HCC recognizes that creator and owner of any image (digital or print), video or audio/video materials submitted to the HCC retains full and complete intellectual property rights to any submitted items.

I agree to grant a license in perpetuity to the HCC to use of any of my submitted items including images (digital or print), video or audio/visual items on the HCC’s website solely for the purposes of: promotion of the HCC, dissemination of club information, club competitions, members’ rankings and clinics,

Creators will receive full credit and acknowledgement for any materials used when possible and practical.

I agree that the HCC may enter any of my submitted items into any external competitions in which HCC might participate. Further, I agree to be bound by the terms and conditions of those external competitions and that for the purposes of any external competition, my contact information may be shared as required with any external bodies.

Refunds

Workshops and Outings

If a member signs up for a cost involved event and subsequently that member wishes to cancel their participation in the event, there will be a $5 cancellation fee levied and withheld from the refund. This fee is used to reimburse the club for the associated payment processing costs that the club may incur.

Any such refund is subject to the following condition: If an event requires a set number of participants to cover the cost of the event or if an attendance number is mandated by the venue, there will be no refunds until the participant number requirement is attained and there is someone on the waiting list who is willing to take the place of the member who requests the refund. If the number of members signed up falls short of the required number, there will be no refund unless the event is cancelled by the club in which case there will be a full refund with no cancellation fee.

In the case of a member forgetting about or not attending an event they have registered to attend, no refund or credit towards a future event will be provided.

Any member may do a member to member exchange of a reserved event spot in any workshop or outing provided that prior to the event the cancelling member informs the event organizer of their withdrawal and provides the organizer with name of the person who is taking their place. Any event entry fee exchange is a matter between the two members on a private basis.

Exceptions for compassionate reasons will be considered on a case by case basis.

Guest Policy

Events and activities throughout the club season are financed through membership dues. We do allow the public to attend some of our events free of charge but there are some other events that we ask non-members pay a fee to attend.

For some club events, Guests and/or visitors are permitted to attend up to two meetings. Subsequent attendance is permitted only after full payment of membership dues. If you decide that you want to join any Guest fees paid will be applied towards your membership fee provided you join at the meeting attended as a guest or the next scheduled meeting only.

Please be sure to check our upcoming events page for both events that guests may attend and the associated guest fees, if any.

Some workshops and outings may also be available to guests but priority will always be given to club members.

To join in on a virtual (Zoom) event, just email membership@hamiltoncameraclub.com for access information.

All guests will be required to sign a guest book before entering.
